    Even adults are stupid. Unfortunately, that stupidity will result in enforcement and intervention by the ORR and/or the courts. It is also wholly unpleasant for the relatives of the deceased.

    Agreed. My point is that, where people are killed or maimed by their own stupidity, other innocent bystanders are unwilling witnesses and staff have to deal with the resulting consequences.

    If any of us do anything stupid the likelyhood is that there is an impact on others , whether it is through witnessing what could be something horrible , maybe even a death or serious injury , there are those who have to clean up, the medical teams , the impact on the persons family and their future and many more

    the not unreasonable question that will be asked in any investigation is what was done to prevent the accident occuring ? , how could this have been prevented ?

    Ultimately and unfortunately, we as in humans, are entitled, inventive, boundary pushing (especially where rules are concerned) and masters of our own downfall . Not unreasonably the leglisation is focused on removing our ability to be stupid and especially there will be those who think the rules do not apply to them

    That is all perfectly true, but leaves unanswered why H&S seems to impose more severe restrictions in the UK than apply in other countries.

    maybe its about that in the UK we value life and its preservation (or at least the avoidance of premature death) differently to other nations who have a different attitude

    I find that foreign railways adopt the principle that if "you take risks you accept the consequences - legal or otherwise". Here in the UK the principle of preventing the risk in the first place is often an excuse to avoid responsibility by imposing the risk (and the consequence) on the individual with the usual "not my fault Guv - warning was given but he / she ignored it"
