    I note that the date for representations on the proposed change to charges for charter tours has passed. I wonder how much this incident, and that of 47500, would cost the TOC in penalties?

    This item is also in LE movements, and it does concern me that delays caused by this incident, and others similar, would be expensive under the proposed ORR changes for Charter Operator fees.

    Precisely and since a check rail has been installed since the incident it does make you wonder....

    Having read the document I understand that there is absolutely no differentiation made between what the journey is. If there is a failure caused by the TOC stock, whether hired in or not, charges are made to compensate the delays caused to other trains.
    I forget what the cost is, but I think it is £'s per minute. At present the max. is £5000 with NR paying the difference. That will be changed in the future, perhaps!

    If it causes a delay to any service then a fee should be due.
    However that all depends on whose fault caused the delay.

    If it was caused by the Loco + Coach then it would be the operator.
    If it was a track fault then it would land on a NWR desk.

    Speculation is pointless, but suggests flange climb, not suppressed by a check rail or lubrication. However as it is the only thing to come to grief it makes me wonder that these may only be some of the factors. The RAIB will report and will obtain OTMR data and I will be interested to see the speed at the point of derailment. Another issue may be a dead weight rolling on the back of a lightweight train. All of the above will come out in the wash.

    Most accidents are - accidents - and caused by a number of 'unlucky' situations coming together at the critical moment. After an incident the response should be to ensure that as far as reasonably possible - the risk of those situations can be reduced or cleared.

    I would agree with that comment.
    Sorry if I started something, my point was that this is the sort of incident which can cost money from TOC's,or NR, which we as punters may not appreciate since it is not an active charter train, so a charge on every separate incident can become expensive over the years running. NR is bailed out by tax payers. TOC's run on income from tours and hirings.

    I'll go back into my shell again!! The breath of fresh air was nice, especially hot and steamy!

    Track is NR's responsibility, so they seem likely to carry the can on the evidence we have.

    wont speculate as to how, if or why.

    now a derailed tender at Wolstzyn's turntable involves 4 burly guys going off to get jacks and a lot of puffing and grunting in true polish style within the hour.. The loco is on its way.

    hows it 7 hours later the wheel is still in the dirt in the UK and dozens of soft skinned hands, suited orange jacket types gauping at it and scratching their heads ?

    Not so much a skid mark, more a reflection on the shiny railhead of the yellow paint on the axlebox. IMHO.
